The best example
can be taken on this reference is the burning case of Unnao gang rape in which
a BJP MLA is accused. A 17-year girl, allegedly raped by BJP MLA Kuldeep Singh
Sengar, his brother Atul Singh Sengar and his other accomplices, in Unnao
district on June 4, 2017. The victim’s family moved to file a complaint about
the incident but according to the family the police authorities rebuffed. Unnao
Rape Case caught another ‘trending case’ tag in India’s
bulking rape incidents after when the victim tried to ablaze herself in front
of Chief Minister’s residence, in Uttar Pradesh on April 8, 2018. The crawling
of Uttar Pradesh’s system forecasted under the political influence after then. It’s
been two year now and the case is unsolved.
The recent turning point in this case took place on
28 July, 2019, where a blackened no. plate truck hit the victim’s car near
Raebareily. The victim including his lawyer were seriously injured and admitted
to King’s George Medical College, (KGMU), Lucknow, while victim’s aunts
breathed last right after the accident. In-spite of getting police protection,
no trace were seen of security on the accident day. Strange to gulp the way it
happened.

Bollywood movie, where the scriptwriter eventually making the director directs
the scenes favourably. This case has many layers hidden in it. Each character
involved in this case be it from defendant or plaintiff has an enormous and
important role.
Unfolding this layer, it will be seen and it will be
crystal clear how the scriptwriter (political influence) has made the humanity,
trust, justice and truthfulness dance on its index finger.

and her family where the victim goes missing and allegedly raped by Sengar, his
brother and other accomplices. Unknown from the reality, the victim’s father
file a complaint of his daughter missing.

21, 2017: Victim Found in Auurayia.
The girl found in Auurayia district, of Uttar
Pradesh. After then the victim along with her family went to file the case
against Kuldeep Singh Sengar on June 22, 2017, but the authorities denied to
mention the Sengar’s name in complaint file. Anyhow the case was filed of
kidnapping.
Now here the question arises that being in the democratic country one has a complete right to file a complaint against anyone, irrespective of designation. Why the police refused to mention sengar’s name? Just because he was the political leader of that district and police authorities were under his influence?

3, 2018: Father Thrashed By Kuldeep Singh Sengar and Atul Singh Sengar.
The pitch of the case goes little up when the sengar
brothers had beaten and haraased the victim’s father showing the power of being the
leader. The Complaint was registered from both the parties but police arrested
victim’s father.
Clearly, the power of politics turned the dice and
victim’s father locked up in jail. Again the question on police authorities
pops up. Without having the proper evidence. How police arrested victim’s
father and took him into the custody?

8, 2018: Victim along with her mother and sister tried to ablaze infront of
CM’s Yogi Adityanath Resident, in Lucknow.
Tired of inaction of the police against Sengar,
family threatened by the goons of Sengar and system’s negligence, victim tried
to immolate in-front of CMs resident. From here the incident caught the rhythm
and this case came into light of everyone’s eyes. The media coverage and
continuous trolling of police authorities of Unnao, the UP government decided
to look into the matter and CM Yogi gave the statement of giving justice to the
Victim. On the other hand, the case came in the eyes of Allahabad High Court
and it ordered to include CBI in the case.
But, the news right after the day shaken the
humanitarianism in which the victim’s father died in police custody on April 9,
2019. The post mortem report says that the death was due to blood poisoning due
to perforation of colon injuries. This is really hard to believe how the power
can ravel the innocence. Everyone knows the reason behind death but no
officials speaks up on the death cause but beating around the bush only.

11, 2018: Victim along with her mother and sister were locked in Hotel Room
without water and electricity.
Again, a heart-throbbing incident took place on the
name of security under the UP Government. Victim with her mother and sister
were locked up in a hotel room on the name of protection and that too with no electricity
and water. This led to think from the humanity perspective that how the weaker
section get trapped in the fierce system, which we called it as a Democracy.

12, 2018: Kuldeep Singh Sengar, Atul Singh Sengar, and their accomplices got
arrested by CBI.
Sudden media coverage
and social media power worked up and the accused finally got arrested. But this
was not a cold ice for the case because this shows the paralysed police system
of Uttar Pradesh where the accused who holds some power was free under their
working.
When asked about the delay in arresting of Sengar,
Yogi Adityanath gave the statement of diplomacy without being specific. This
shows the political preview where it is meant to keep quiet if found hole in one’s
own box.

2, 2019: Victim’s uncle sentenced to 10 year jail by district court, after Atul
singh filed a case of Attempt to Murder against him.
Now here the issue got personal and it went on ego
as well for Sengars. Atul sengar, brother
of Kuldeep Sengar filed a case of
attempt to murder against victim’s uncle almost two decade ago and expectedly
for them victim’s uncle is trapped.
Isn’t it strange? How fast the district court passed
on the judgement? How fast the police got into work? Well, here the judgment
speed is directly proportional to the level of authority one holds. May be
because of Democracy which is only meant for the ruler, by the ruler and of the
ruler. Similar was in the case with Sengars’.
Now the masterstroke comes on the day 28 July, 2019,
where victim’s car was lethally thrashed by a truck near Raebareily. This
sensitised the case once again after 15 months. The victim and his lawyer are
on critical states now. On the other hand victim’s aunts who were also in the
car was dead on the spot. According to the news, one of the aunts was main
evident for the case.
PTI published
that According to victim’s mother, the accident was planned by the Sengar’s
goons to wipe out the family. While the DIG of Lucknow, OM Prakash Singh, gave
the statement that this was just the normal accident and it has no connection
with the Sengar.
Also, another point to conclude here is important
that after this all happenings, Bhartiya Janata Party (BJP) didn’t expel the MLA, Kuldeep
Singh Sengar till the media and social platform pressurised the party on asking
reason about Kuldeep Sengar still existing in the party.
Another point is that the rest of the MLAs, out of
many supporting Sengar and giving diplomatic opinion about the case. Where some
leaders are giving confusing statements. According to the BBC News, In an
Event, the MLA of Hardoi District, Ashish Singh was seen giving sympathy
statements to Sengar, calling him the elder brother and covering up his
crime. Since the Kuldeep Sengar is no
longer the BJP member, but the MLAs supporting him this way is the big question
mark on living in a democratic country where a criminal known by everyone is
still being supported by his fellow colleagues and treated respectfully.
Why this kind of approach we don’t see when a common
man gets trapped in a case, and doesn’t sentenced guilty? Why the society see
him as a criminal even after proven innocent? Why society don’t accept him as a
normal creature?
Reason being is the mentality we have fed to our
brain, where a person having some designation/ authority is considered as an
idol no matter how evil he is from inside. The perception of the society
completely ruled by the fierce grip.
This case anyhow shows the dynamics of system power
in the state about how a strong leader can result as an influencer and
paralyses the authorities sitting to serve the common public.
The inaction of Police Authorities, Father’s death
in police custody, Uncles’ sentenced to 10 year jail, all these threats on family, the delay in
reaching the victim’s letter to Chief Justice, no financial aid by the state
government till the orders and the car accident by blackened no. plate truck
including the absence of security provided. All this incident can’t be a
co-incident actually and that too all one after another. There shows the master
planner and the strategic planning that is controlling the system in a rhetoric
manner.
The question is not about the solution and getting
the case to be in the court. The actual question arouse on the Uttar Pradesh
Government and their negligence on such a serious issue. This shows the dualism
of the system when comes on serving the weaker/common public against the power.
The democracy is meant not only for the people who holds some renowned
designation but it is applicable similarly who lives in the country as a
commoner.
Democracy doesn’t give the authority to violate the
human rights and graveyard the humanity. It states to treat each individual
equally. Indian Constitution is made for the crimes not for tantalizing the
humanitarianism.
It must be
understood from the basic point of view that system is meant to serve the
public not to snatch the right from the public. Many incident come, stay and
fades away. But, the corruption, illegal frames and violations is still ruling
the society. Question is not about being quick in solving the issue but on why
is it taking the birth on a frequent basis? It is important to understand the
deep-rooted cause of mishaps in the society and crawling of system than to bang
on the issue from the crust.
Legal
Progress
:
Taking
about the legal progress of this case then, after the media coverage and
getting the victim’s letter by chief justice of India, the supreme-court
ordered to transfer this Case to Delhi along with 5 other cases related to this
case.
Also, supreme-court ordered the UP government to
give the compensation of Rs. 25 Lacs to the victim’s family. Also, on 5 august,
the victim shifted to All India Institute of Medical Science (AIIMS) on Supreme
Court order.
CBI demanded 18 witnessed to be provided Protection.
On the other hand, CBI reaches out the residence of
Kuldeep Sengar for further investigation on August 9, 2019.
